Applying for a NT RCB assessment
A Northern Territory (NT) employer wishing to make an application for assessment to the regional certifying body (RCB) should complete the regional certifying body advice form 1404 and provide supporting documentation.
The following checklist provides a list of documents that need to be submitted to the NT RCB when a NT employer is applying for an RCB assessment.
Required documentation must be provided as an Adobe PDF or Microsoft Word DOC / DOCX attachments to the email only, no 'cloud' downloads.
The documents required vary depending on whether the sponsoring employer is:
- a public company (listed on the ASX)
- a government department / agency, or
- any other organisation or business.
Publicly listed companies / government departments or agencies
- Regional certifying body advice form 1404. Get form 1404 from the Australian Government's Department of Home Affairs website.
- If the business is using a migration agent form 956 must be signed by both the agent and the nominating employer, confirming that the agent is acting on the employers' behalf. Get form 956 from the Department of Home Affairs website.
- Statement from the employer on how the position contributes to the business outputs including a job description.
- Australian Business Register and Australian Securities and Investments Commission database extracts for the nominating business.
- Letter of offer / employment contract outlining terms and conditions and referencing either:
- the relevant enterprise agreement, or
- where there is no enterprise agreement, the relevant award.
- A statutory declaration (this is not required for a government department) stating that the terms and conditions applicable to the position will be no less favourable than the terms and conditions that are provided or would be provided to an Australian citizen or an Australian permanent resident for performing equivalent work in this business.

There is a genuine need for the nominator to employ a paid employee to work in the position under the nominator's direct employment, for example, not employment through a recruitment agent.
The position cannot be filled by an Australian citizen or an Australian permanent resident who is living in the same local area where the nominated position exists.
The declaration must include the business name, ABN and the terms and conditions being offered. It must also be signed by a person authorised by the nominating employer to make such an undertaking.
- Evidence that the business is unable to recruit locally (genuine job advertisements, recruitment outcomes and other evidence of recruitment activities).
- Employee profile including their CV, qualifications, passport ID page, number of dependants and current visa or last substantive visa if on a bridging visa (if applicable).
There may be circumstances where NT RCB case officers request additional documents to support their assessment decision.
All other employers
- Regional Certifying Body advice form 1404. Get form 1404 from the Department of Home Affairs website.
- If the business is using a migration agent , form 956 must be signed by both the agent and the nominating employer, confirming that the agent is acting on the employers behalf. Get form 956 from the Department of Home Affairs website.
- Business profile (or link to the business’s website if the website has a business profile or annual report).
- If the business is involved in a trust arrangement, please provide a copy of the trust deed.
- Organisation chart of less than six months old (showing the position, reporting structure and number of employees).
- Job description.
- A full financial report for the previous financial year and BAS statements from 1 July until present.
- Australian Business Register and Australian Securities and Investments Commission database extracts for the nominating business.
- Documents showing:
- if an Australian or Australian permanent resident is undertaking the same job in the business the terms and conditions of payment (payslips and employment contracts), or
- if there is no Australian or Australian permanent resident undertaking the same job in the business, the terms and conditions of employment (payslips and employment contracts) of any other employee currently or previously undertaking the same job in the business.
- Letter of offer / employment contract outlining terms and conditions and referencing either:
- the relevant enterprise agreement or
- if there is no enterprise agreement in place the relevant award.
- A statutory declaration stating that the terms and conditions applicable to the position will be no less favourable than the terms and conditions that are provided or would be provided to an Australian citizen or an Australian permanent resident for performing equivalent work in this business.
- Evidence that the business is unable to recruit locally (genuine job advertisements, recruitment outcomes and other evidence of recruitment activities).
- Employee profile including their CV, qualifications, passport ID page, number of dependants and current visa or last substantive visa if on a Bridging Visa (if applicable).
